Can I file a small claims action to recover lost wages for a personal injury at a business?

Additional Details:
Business left plastic sheeting in the aisle and I tripped on it walking to checkout. Business
liability carrier paid the maximum for medical expenses but refuses any additional liability
compensation. My attorney refuses to file suit. I lost wages due to the injury.

You can file a small claims action. Before doing so, however, it would be useful for you to ask the attorney why she refuses to file suit. Is it because the case is too small or because the attorney believes you will lose. With that additional information you should be able to make an informed decision. Good Luck
