Employee Was A Peeping Tom

Q. 

Today, I was a victim of a "peeping tom" while in a tanning booth. I opened the bed before the time was up as I was very hot, and caught him peeking over the top of the wall. I was very shocked and angry at the time. I did call the police and am pressing charges against the employee (who was supposedly up there to kill a spider he had noticed in the vent...) As my shock is wearing off, I am having waves of OMG - he saw me topless and probably more. Was there a camera?? I feel VERY violated.

Is there a law that the business owner OWES his customers privacy(especially in a tanning salon)? Is there special training the owner was, and is, obligated to provide to employees? I don't want to punish the business owner for a bad employee but, on the other hand, I would like to know what the reasonable expectations of the business owner are - especially in tanning salon situations.

I am sorry to hear about what happened to you. It is completely unacceptable. While I am not sure about the laws in your state, you would have a potential claim against both the employee and the salon owner for intrusion on seclusion and/or intentional infliction of emotional distress in Texas. The business owner owes you a duty to properly hire, train and supervise its employees. You should contact an experienced attorney in your area to discuss your options. Good luck.
