Can you sue your own insurance company?

That depends on the situation. Many drivers only carry the minimum legal requirement, which in Texas is for liability coverage if you cause someone else's accident. But if you carry personal injury protection (PIP) you can collect small amounts (generally up to around $2,500) from your own insurance company without filing a lawsuit. If the other party does not have insurance or has insufficient insurance to satisfy your claim, you may be able to make a claim against your own insurance company if you carry uninsured/underinsured (UM/UIM) motorist coverage. In this case, your insurance company may settle the claim with you or you may have to file suit against your own insurance company.
