Hiring An Attorney Where An Accident Occurs
Daniel B. Ross

Q.

If an accident happens in one state, and you live in another state, do you have to use a lawyer where the accident happen?

A.

In general the answer is no, you do not need to use a lawyer in the state in which the accident happened. As a general rule, however, it is best to have an attorney who is familiar with the laws of the state where the accident happened. If you are pursuing the matter prior to litigation by filing a claim against the responsible party's insurance company, then an attorney almost anywhere would be able to assist you. However, should the case proceed to litigation, you would need an attorney licensed or otherwise authorized to practice law in the state where the accident occurred or where the lawsuit is filed.

It is always a good idea to consult with an attorney to learn about the laws that apply to your specific situation and what your options may be. I wish you the best.
