I was in a car that was hit head on by a drunk driver on 11/29/08. We were sitting at a light waiting to turn left when he blew the red light and wiped us out in my Miata. I have a broken c7, as well as a few other minor injuries that, even though they still get irritated, only the back and right arm would I consider serious enough to mention. Being that I am in Texas I am worried that his policy may be only 25K, the legal requirements of the state. My trauma bills alone are over 25K. Will I need to privately sue him after his insurance company if his policy doesn't cover all of my bills? As well as I am aware I may have gone through all of this without and compensation for pain and suffering. The not knowing sucks!

I am sorry to hear about your wreck and injuries. You have a complicated issue, but there's hope. First, be aware that the minimum liability in Texas is $20,000, not $25,000. There are ways to determine the liability limits prior to filing a lawsuit. Additionally, there may be other coverage that might be able to help compensate you for your injuries.
