Q.
I was rear ended 7/24/09 I suffered a neck sprain, cervicalgia. I am in pain everyday since the accident; the other party's insurance wants to offer me $500.00 for pain and suffering, is this what I should expect?

It sounds like you should seek the assistance of a qualified personal injury attorney. Pain and suffering damages can be difficult to assess, but $500 is not very much. If you retained an attorney and your case proceeded to trial, the amount that a jury awarded you would depend on all of the evidence of medical treatment and expense as a result of the accident, and pain and suffering in an amount to be determined by the jury. If you have significant medical expenses, it is likely that a jury may award you more than $500 for pain and suffering. In order to properly evaluate your case and the possible outcomes if you proceeded to trial, you should seek the assistance of an experienced personal injury attorney.
