Premises Liability Case
Daniel B. Ross

Q.

If you got hurt on the property where you live in a apartment complex and you had a to get surgery, what is the least you could get for your injury on the liability insurance?

-- Tammy

A.

You have one of the more difficult cases - a "premise liability case." For a premise liability case, you will have to prove that there was an unreasonably dangerous condition on the premises, the owner knew or should have known of the condition, and the owner failed to correct and/or warn of the condition. These types of cases are difficult to prove, and you would benefit from the assistance of an experienced personal injury attorney.

As for the amount of damages, that would be dependent on your injuries, the amount of your medical bills, loss of earning capacity, physical pain, mental anguish, and disgigurement. Each case is different, and there is no formula. Again, an experienced personal injury would be helpful. I wish you the best and hope for your speedy recovery. Good luck!
