Slip and Fall Case
Daniel B. Ross

Q.

My healthy father fell in a resturant in April and has died due to complications of the fall. The fall was inside the resturant, one step down to dinning room that he missed. The step was not marked or had a sign. Should I sue?

I am so sorry to hear about your loss. You have a potential case against the restaurant but it's a difficult case. Essentially, you would need to show that there was an unreasonably dangerous condition on the premises, the owner knew or should have known of the condition, and the owner failed to correct and/or warn of the condition. These types of cases are difficult to prove

Whether or not you pursue legal action is up to you. I suggest that you contact an experienced personal injury attorney in your state to discuss your options and the viability of the potential claims. I wish you the best.
