Texas Car Accident Underinsured Motorist Coverage
Justin Demerath

Q.

I was seriously injured in a car accident. My medical bills alone are already over $25,000.00, and the at fault driver has only the state minimum coverage. What are my options?

A.

I am sorry to hear about your loss. The minimum liability coverage amounts in Texas are currently 25/50/25. This means that an insurance policy for minimum coverage will pay up to $25 thousand for the bodily injuries of a single person involved in an accident, up to $50 thousand for all bodily injury damages (regardless of the number of persons) in a single accident, and up to $25 thousand for all property damage in a single accident. Because the at fault driver in your situation possesses only the minimum policy amounts, the most that insurance company is liable for is $25,000.00 for your bodily injuries.

If you have uninsured/underinsured motorist coverage, you will likely be able to make a claim against your insurer for the amount in excess of the policy limits of the other driver. I advise you to seek the counsel of an experienced personal injury attorney right away.
