Security Firm May Be Liable for Injury to Customer
Safeway customer Steven Simon left the store after purchasing some items. Outside the store, an employee of Sonoran Desert Investigations, the firm hired by Safeway to provide security, accosted Mr. Simon and accused him of shoplifting. Mr. Simon insisted on talking to the manager, and went back into the store to do so. Taken to a back room, Mr. Simon claimed that he was assaulted. Safeway moved to dismiss Mr. Simon’s subsequent lawsuit, claiming that Safeway could not be held liable for the actions of the security company, which Safeway claimed was an independent contractor. The lower court agreed, but the Appeals Court reversed, stating that when the regulations for the security company are set by its employer, Safeway, the employer can be held liable.
Victim Sues for Injuries Caused By Chimpanzee
Perhaps one of the most well-known personal injury cases in the country involves the woman who was nearly mauled to death by her friend’s chimpanzee, at her friend’s home. The victim has undergone several life-saving surgeries already, with grievous injuries to various parts of her body. Her lawsuit (brought on her behalf by her family) alleges that the chimp’s owner was negligent in keeping the animal in her home and in allowing it access to people coming to visit.
Airline Crash May be Pilot Error
Another case in the news is the tragic crash of a Continental commuter plane en route from Newark, New Jersey to Buffalo, New York. While the investigation is still in its early stages, it appears that the victims’ families and representatives may claim that the pilots were negligent in their operation of the plane, and that the airline was negligent for failing to provide proper training to the pilot and copilot. It is likely to be many months or even years before the facts of the accident are known.
