Are your psychotherapist's notes and records private?

If you file a lawsuit, maybe not. I recently wrote about this issue for the Florida Bar Journal, in article called "The Shield and the Sword." The article appeared in the March, 2007 issue, and is available online through the bar's website. The Trial Lawyers Section of the Florida Bar also discusses the issue in their Handbook on Discovery Practice.
