Six window treatment manufacturers recalled over five million blinds and shades today after three children were strangled in attached cords. At least one expert estimates that one child dies each month in the U.S. due to strangulation from a window cord. Our firm has represented families that have lost children, and our hearts go out to those affected by these preventable tragedies. It’s a pain and feeling of loss like none other.
From a legal standpoint, these incidents illustrate important considerations common to almost all wrongful death cases. Specifically, careful consideration must be given to ALL factors and entities that contributed to the death.
For example, in a wrongful death case involving a dangerous product, the manufacturer may be found liable in the legal proceeding. But what about the company that sold the product? Or installed it? Similarly, if the product was being used in a business such as a daycare, what responsibility do the owners have to keep their children safe?
These are complex legal issues that require significant investigation. Wrongful death cases usually require accident reconstructionists and opinions from other safety experts.
The law firm of Henry Spiegel Milling, LLP in Atlanta continues to represent families across Georgia that have suffered the loss of a loved one from a wrongful death. And we will continue to zealously fight for safe products in the market place, especially those that come in contact with our nation’s children.
