What is assumption of risk?

Lombardi and Lombardi, personal injury attorneys in New Jersey, handle injury cases throughout the tri-state area. In certain areas, during a personal injury case, the defendant may utilize the "assumption of risk" defense.
Assumption of risk is defined for the defense in the law of torts, in which bars a plaintiff from recovery against a negligent defendant, if the defendant can prove that the plaintiff voluntarily assumed the risk in which caused injury. Also, known as primary assumption of risk, this is an attempt to relinquish duty of care.
