The streets and sidewalks of the Bronx have given rise to countless accidents followed by lawsuits from injuries that have arisen on those byways. It has been estimated that the most common case against New York City is a trip and fall accident caused by a defective pedestrian sidewalk.
Prior to 2003, a person who fell and was injured because of a defective sidewalk would usually sue the City of New York. But in 2003, the law changed when the City Council enacted a law that transferred legal liability from the city to the adjoining landowner. What this meant was that after 2003, the person who slipped and fell was required to sue the adjoining landowner in front of whose property the fall was caused. (Note that there is an exception for one, two, or three family owner-occupied homes. Slips, trips, and falls in front of those types of premises are still the liability of New York City. )
