My daughter died as a result of choking while in a day facility operated by the Ohio Department of D
investigations and did not come up with any negligence on their own part. She had requirements for her food to be cut up. I believe the caregiver did not notice she was choking right away, delayed calling for help, the phones in the place did not connect to 911 when they called, they performed the Heimlich wrong and were supposedly certified by Red Cross in CPR, when they laid her on the floor, they placed her in a rescue position instead of continuing CPR. She had neurological deficits and was in the day facility because she required care. It is coming up on the 2 year mark, which is the statute of limitations. Do I have any other recourse. She was an adult but I have administratorship of her estate. I had visited with a lawyer who stated that it would cost me 25000 to file the suit to cover his out of pocket expenses. The facility is run by a county board but gets some federal funding.
Can Lawfirm disburse funds from Wrongful Death Settlements that involve multiple companies, if only
We received a total award in excess of 200,000. 10 Defendants paid an average of 20,000. ONE Defendant reported to Medicare, that There was medical bills totaling 4,000. The lien amount is apparently 20,000. Can the Other 180,000 be disbursed. Or is Lawfirm required to Hold ALL disbursements until Medicare resolves the single issue? Settlements were received in May 2011.
I have already asked this question one time and it was never answered so I am trying again.
My mother in law suffered a head injury that lead to death in the hospital. After the suit was filed and the lawyer took his cut a very small portion of the money was distributed and the rest was held in a trust for medicare to declare free or submit an amount to be recovered to them. After a few months we started checking with our lawyer and were told repeatedly Medicare had everything they needed it just took a while--we called every month for 6 months and were told the same thing. 10 1/2 months in we just found out he had not filed anything--he has been holding our money all this time and done nothing, and told us any interest the money earned while we were waiting would not be ours. We were repeatedly lied to. What can we do?

How to go about viewing Trust account or Bank account that holds proceeds from numerous Defendants.
If Their are 20 defendants who have settled and paid Lawfirm, can the Plaintiffs ask Their Firm, to view Bank Accounts that hold Funds?
